Z\u00e1konn\u00edk pr\u00e1ce upravuje jej najvy\u0161\u0161iu pr\u00edpustn\u00fa t\u00fd\u017edenn\u00fa i ro\u010dn\u00fa hranicu, do ktorej mo\u017eno zamestnancovi pracovn\u00fa pohotovos\u0165 nariadi\u0165. Pracovn\u00fa pohotovos\u0165 m\u00f4\u017ee zamestn\u00e1vate\u013e nariadi\u0165 najviac v rozsahu <strong>8 hod\u00edn<\/strong> v t\u00fd\u017edni a najviac v rozsahu <strong>100 hod\u00edn v kalend\u00e1rnom roku<\/strong>. Nad tento rozsah je pracovn\u00e1 pohotovos\u0165 pr\u00edpustn\u00e1 len po <strong>dohode<\/strong> so zamestnancom.<\/p>\n<p>Z\u00e1konn\u00edk pr\u00e1ce nerozli\u0161uje pri stanoven\u00ed rozsahu pracovnej pohotovosti \u010di ide o\u00a0akt\u00edvnu, alebo neakt\u00edvnu \u010das\u0165 pracovnej pohotovosti. V\u00a0na\u0161om pr\u00edpade sa jedn\u00e1 <strong>o\u00a0neakt\u00edvnu \u010das\u0165 pracovnej pohotovosti v\u00a0mieste V\u00e1\u0161ho bydliska<\/strong>. Tomu, kto dr\u017e\u00ed pohotovos\u0165, iste netreba pripom\u00edna\u0165, ako je obmedzovan\u00fd (zdr\u017eiavanie sa v\u00a0mieste bydliska, nie je mo\u017en\u00e1 realiz\u00e1cia Va\u0161ej popracovnej \u010dinnosti, n\u00e1stup na poruchu v\u00a0\u010do najkrat\u0161om \u010dase, n\u00e1stup na poruchy aj v\u00a0nepriaznivom po\u010das\u00ed, parkovanie slu\u017eobn\u00e9ho vozidla, at\u010f.).<\/p>\n<p>V\u00a0priebehu t\u00fdchto dn\u00ed V\u00e1m bola doru\u010den\u00e1 prezent\u00e1cia a\u00a0zmluva na podp\u00edsanie pohotovosti v\u00a0\u010do najkrat\u0161om \u010dase, a\u00a0to pravdepodobne do 3 dn\u00ed. Nie ka\u017ed\u00fd z\u00a0V\u00e1s m\u00e1 \u010das sa zamyslie\u0165 a\u00a0poprem\u00fd\u0161\u013ea\u0165 \u010di je v\u00fdhodn\u00e9 podp\u00edsa\u0165 pohotovos\u0165 za uveden\u00fdch podmienok. <strong>Na prv\u00fd poh\u013ead<\/strong> to vyzer\u00e1 celkom dobre a\u00a0nie je d\u00f4vod nepodp\u00edsa\u0165 tak\u00e9 v\u00fdhodn\u00e9 nav\u00fd\u0161enie pohotovosti. Napriek tomu n\u00e1m volaj\u00fa \u013eudia a\u00a0\u017eiadaj\u00fa n\u00e1s o\u00a0vysvetlenie a\u00a0n\u00e1zor \u010di maj\u00fa alebo nemaj\u00fa podp\u00edsa\u0165 pohotovos\u0165. Probl\u00e9m vid\u00edme v\u00a0tom \u010do je nad tabu\u013ekami.<\/p>\n<p><u>\u00a0<\/u><strong><u>Zv\u00fd\u0161enie minim\u00e1lnej mzdy pre rok 2018 = 480 \u20ac. <\/u><\/strong><\/p>\n<p>Zv\u00fd\u0161enie minim\u00e1lnej mzdy na 480 \u20ac, \u00a0je to v\u00a0podstate iba odhad a\u00a0nie suma potvrden\u00e1 z\u00e1konom. Ak by sa tak aj stalo, jednalo by sa o\u00a0najvy\u0161\u0161ie nav\u00fd\u0161enie minim\u00e1lnej mzdy \u2013 to v\u0161ak nie je moment\u00e1lne podstatn\u00e9. <strong>D\u00f4le\u017eit\u00e9 je, aby sa V\u00e1m suma 480 \u20ac dostala takpovediac pod ko\u017eu &#8211; e\u0161te vysvetl\u00edme pre\u010do.<\/strong><\/p>\n<p><strong><u>(20% minim\u00e1lnej hodinovej mzdy = 0,55 \u20ac) \u00a0<\/u><\/strong><\/p>\n<p>Citovanie z\u00e1kona je vytrhnut\u00e9 z\u00a0kontextu a\u00a0suma 0,55 \u20ac je vypo\u010d\u00edtan\u00e1 zo sumy 480 \u20ac. Z\u00a0tohto \u00fadaju vych\u00e1dza n\u00e1\u0161 zamestn\u00e1vate\u013e. <strong><span style=\"color: #ff0000;\">To znamen\u00e1, \u017ee zamestn\u00e1vate\u013e si cen\u00ed Va\u0161u odmenu za pohotovos\u0165 tak, \u017ee ju\u00a0vypo\u010d\u00edtava z\u00a0minim\u00e1lnej mzdy a\u00a0e\u0161te pod\u013ea v\u0161etk\u00e9ho zara\u010fuje pracovn\u00edkov Stred\u00edsk \u00fadr\u017eby do stup\u0148a n\u00e1ro\u010dnosti 1.<\/span> <\/strong><\/p>\n<p>Pr\u00edloha \u010d. 1 k z\u00e1konu \u010d. 311\/2001 Z. z. Domnievame sa, \u017ee ani jeden pracovn\u00edk vo firme venuj\u00faci sa odbornej \u010dinnosti by nemal a ani nem\u00f4\u017ee by\u0165 zaraden\u00fd v\u00a0prvom stupni n\u00e1ro\u010dnosti.<\/p>\n<p><span style=\"color: #ff0000;\"><strong><u>N\u00e1vrh = nav\u00fd\u0161enie n\u00e1hrad 5% nad \u00farove\u0148 (predch. roku) pre 3. ro\u010dn\u00fd kontrakt<\/u><\/strong><\/span><\/p>\n<p>V\u00fdpo\u010det nav\u00fd\u0161enia je samozrejme spr\u00e1vny \u00b1 nejak\u00e1 t\u00e1 desatinka, zar\u00e1\u017eaj\u00faci je v\u0161ak ten 3. ro\u010dn\u00fd kontrakt. Zamestn\u00e1vate\u013e odhaduje, \u017ee v\u00a0roku 2018 bude min. mzda na \u00farovni 480 \u20ac, \u010do predstavuje cca 10 % n\u00e1rast, ak\u00fd bude n\u00e1rast v\u00a0roku 2019 alebo 2020? Jednozna\u010dne, pre t\u00fdch \u010do nech\u00e1pu, <strong>musia u\u017e pochopi\u0165, \u017ee je v\u00fdhodn\u00e9 podp\u00edsa\u0165 pohotovos\u0165, alebo \u017eeby nie?<\/strong> Ak dobre \u010d\u00edtame, tak pod\u013ea \u010derven\u00fdch r\u00e1mikov ste na tom najlep\u0161ie a\u00a0pracovn\u00edk v\u00a0SSE-D dr\u017e\u00ed v\u00a0priemere 1553 hod\u00edn pracovnej pohotovosti. <strong>Pozor,<\/strong> pod\u013ea spodn\u00e9ho riadku tabu\u013eky ste na tom naopak najhor\u0161ie a\u00a0teda si za rok prilep\u0161\u00edte najmenej iba o <strong>91 \u20ac (v priemere 7,5 na mesiac)<\/strong>. \u00a0\u010co teraz? \u010co sa stalo? Treba \u017eiada\u0165 dorovnanie pohotovosti minim\u00e1lne vo\u010di VSE a\u00a0maxim\u00e1lne vo\u010di ZSE? V\u00a0skuto\u010dnosti s\u00fa aj oni \u013eudia a\u00a0robia chyby, pon\u00e1h\u013eali sa s\u00a0pohotovos\u0165ou a\u017e tak, \u017ee pozabudli na spr\u00e1vne znamienka.<\/p>\n<p>Teraz trochu v\u00e1\u017enej\u0161ie, uveden\u00e1 tabu\u013eka <strong>nem\u00e1 \u017eiadnu v\u00fdpovedn\u00fa hodnotu<\/strong>, a\u017e sa domnievame, \u017ee je zav\u00e1dzaj\u00faca. V\u00a0nadpise sa dozviete, \u017ee elektrik\u00e1r v\u00a0SSE-D v\u00a0prieme odsl\u00fa\u017ei 1553 hod\u00edn pohotovosti. K\u00a0uveden\u00fdm hodin\u00e1m s\u00fa uroben\u00e9 prepo\u010dty za VSE a\u00a0ZSE. <span style=\"color: #ff0000;\"><strong>Pozor v\u00f4bec neviete v\u00a0akom re\u017eime pohotovosti funguj\u00fa tieto dve spolo\u010dnosti a\u00a0\u010di v\u00f4bec dr\u017eia pohotovos\u0165. A\u00a0pr\u00e1ve v\u00a0tom je to\u00a0mierne povedan\u00e9 &#8211; zav\u00e1dzanie. Porovn\u00e1vaj\u00fa jablk\u00e1 s\u00a0hru\u0161kami a\u00a0e\u0161te s\u00a0jahodami plus do toho zahrnuli 1553 hod\u00edn pohotovosti pracovn\u00edka SSE-D. <\/strong><\/span>Treba si uvedomi\u0165, \u017ee tabu\u013eky, \u0161tatistiky, vyhodnotenia a\u00a0anal\u00fdzy si je mo\u017en\u00e9 upravi\u0165 pod\u013ea vlastn\u00fdch predst\u00e1v. Tak\u00fd je fakt.<\/p>\n<p>Napr\u00edklad: n\u00e1m z\u00a0uvedenej tabu\u013eky vypl\u00fdva, \u017ee v\u00a0ZSE pracovn\u00edci nedr\u017eia pohotovos\u0165, iba v\u00a0nejakom skr\u00e1tenom re\u017eime a\u00a0to sa ani nemus\u00edme nikoho p\u00fdta\u0165. <span style=\"color: #ff0000;\"><strong>Ve\u013ek\u00fd<\/strong> <\/span><strong><span style=\"color: #ff0000;\">probl\u00e9m je v\u00a0tom, \u017ee ur\u010dite maj\u00fa vy\u0161\u0161ie platov\u00e9 triedy<\/span>.<\/strong> Osobne si nevieme predstavi\u0165 elektrik\u00e1ra v\u00a0Bratislave, ktor\u00fd pracuje za menej ako 600 \u20ac, ak tak\u00e9ho maj\u00fa, nech n\u00e1m ho pr\u00eddu uk\u00e1za\u0165. To v\u00a0Bratislave zarob\u00ed viac aj bezdomovec, alebo \u017eobr\u00e1k. Asi tak hlboko sme sa prepadli za posledn\u00e9 roky, bohu\u017eia\u013e s\u00fa to iba na\u0161e a\u00a0Va\u0161e domnienky.
