(SSD). \u017daloba smeruje na Okresn\u00fd s\u00fad v \u017diline ako pr\u00edslu\u0161n\u00fd pre kolekt\u00edvne pracovnopr\u00e1vne spory. Jej podstatou je <strong data-start=\"687\" data-end=\"760\">dlhodob\u00e9 nerovnak\u00e9 zaobch\u00e1dzanie so z\u00e1stupcami odborov\u00fdch organiz\u00e1ci\u00ed<\/strong> zo strany zamestn\u00e1vate\u013ea.<\/p>\n<p class=\"\" data-start=\"788\" data-end=\"1355\">U zamestn\u00e1vate\u013ea p\u00f4sobia dve odborov\u00e9 organiz\u00e1cie \u2013 ZO ECHOZ a ZO NOE. Zatia\u013e \u010do funkcion\u00e1ri ZO ECHOZ maj\u00fa vytvoren\u00e9 podmienky na svoju \u010dinnos\u0165 vr\u00e1tane \u00fapln\u00e9ho uvo\u013enenia z pracovn\u00fdch povinnost\u00ed a vypl\u00e1cania n\u00e1hrady mzdy, ZO NOE od svojho vzniku v roku 2017 <strong data-start=\"1045\" data-end=\"1112\">nem\u00e1 zo strany zamestn\u00e1vate\u013ea zabezpe\u010den\u00e9 \u017eiadne pracovn\u00e9 vo\u013eno<\/strong>. V\u0161etku agendu, zastupovanie zamestnancov v konaniach a obhajobu ich pr\u00e1v vykon\u00e1vame <strong data-start=\"1198\" data-end=\"1223\">vo svojom vo\u013enom \u010dase<\/strong>. Rozdiel v podmienkach medzi oboma odborov\u00fdmi organiz\u00e1ciami je tak nielen z\u00e1sadn\u00fd, ale z poh\u013eadu z\u00e1kona a \u00dastavy SR aj nepr\u00edpustn\u00fd.<\/p>\n<p class=\"\" data-start=\"1357\" data-end=\"1996\">Na\u0161a odborov\u00e1 organiz\u00e1cia vznikla s cie\u013eom re\u00e1lne zastupova\u0165 z\u00e1ujmy zamestnancov. V praxi to znamen\u00e1 pod\u00e1vanie podnetov na in\u0161pekcie, pr\u00e1vnu pomoc zamestnancom, sprostredkovanie komunik\u00e1cie so zamestn\u00e1vate\u013eom, pripomienkovanie intern\u00fdch predpisov, \u00fa\u010das\u0165 na rokovaniach, a v neposlednom rade \u2013 konania pred s\u00fadmi v mene kolekt\u00edvu. V\u0161etky tieto \u010dinnosti si vy\u017eaduj\u00fa \u010das, administrat\u00edvne zabezpe\u010denie, komunik\u00e1ciu a schopnos\u0165 reagova\u0165 operat\u00edvne. <strong data-start=\"1801\" data-end=\"1996\">Bez primeran\u00fdch podmienok zo strany zamestn\u00e1vate\u013ea sa t\u00e1to \u010dinnos\u0165 st\u00e1va dlhodobo neudr\u017eate\u013enou a vo v\u00fdsledku dopl\u00e1ca na to zamestnanec, ktor\u00e9ho hlas by mal by\u0165 prostredn\u00edctvom odborov po\u010du\u0165.<\/strong><\/p>\n<p class=\"\" data-start=\"1998\" data-end=\"2457\">In\u0161pektor\u00e1t pr\u00e1ce Bansk\u00e1 Bystrica u\u017e v roku 2021 potvrdil, \u017ee zamestn\u00e1vate\u013e svojim pr\u00edstupom poru\u0161il z\u00e1sadu rovnak\u00e9ho zaobch\u00e1dzania. Vyzval zamestn\u00e1vate\u013ea na n\u00e1pravu a odporu\u010dil, aby sa zabezpe\u010dili rovnak\u00e9 podmienky aj pre druh\u00fa odborov\u00fa organiz\u00e1ciu. Zamestn\u00e1vate\u013e v\u0161ak odpor\u00fa\u010dania ignoroval a doteraz nepri\u0161lo k \u017eiadnej zmene. Dlhodobo tak pretrv\u00e1va stav, kedy jedna organiz\u00e1cia m\u00e1 podporu a druh\u00e1 je <strong data-start=\"2400\" data-end=\"2456\">prakticky uml\u010diavan\u00e1 pasivitou zo strany vedenia SSD<\/strong>.<\/p>\n<p class=\"\" data-start=\"2459\" data-end=\"2808\">Na\u0161a \u017ealoba nie je o h\u013eadan\u00ed konfliktu, ale o <strong data-start=\"2505\" data-end=\"2581\">obrane pr\u00e1va na f\u00e9rov\u00e9 podmienky a rovnos\u0165 medzi z\u00e1stupcami zamestnancov<\/strong>.
